Protecting the Complainant: Retaliation Risks and Safeguards
This lesson explains how to identify retaliation risks, implement safeguards, and ensure timely reporting and protection for the complainant.

Retaliation Risks and Protections

Retaliation can occur directly or indirectly after a complaint. Early detection includes monitoring for changes in behavior, threats, or intimidation. Encourage reporting of any concerns promptly and securely.

Protective measures. Temporary accommodations, restricted contact with respondents, separate investigation teams, and documented safety plans help reduce risk while investigations proceed.

Reporting and escalation. Provide clear channels for reporting retaliation, including confidential hotlines or designated case representatives, and escalate to HR, Compliance, or Legal as needed.

Documentation and privacy. Keep an auditable trail of signals and actions while protecting sensitive information. Use de-identification where possible and limit access to those with a legitimate need.
