Acceptance and Scope

By using the EverLMS Workplace Harassment and Diversity Training Program you agree to these Terms of Use. These terms form a binding contract between you and EverLMS Inc. and govern your access to and use of the training platform and accompanying materials. The program may include updates or new features and continued use indicates acceptance of any changes. You may access content for legitimate organizational use in accordance with the license granted herein. You may not copy, reproduce, distribute, or create derivative works of the content except as explicitly authorized by EverLMS in writing. You may use the content solely for internal training within your organization and for the purpose of complying with labor laws and workplace policies. The license is non exclusive, non transferable, and revocable at any time without liability, subject to a reasonable transition period. You agree not to circumvent security measures, disable protections, or attempt to access data outside your authorization. You acknowledge that the platform is provided as is and that EverLMS makes no warranties about uninterrupted service, data accuracy, or fitness for a particular purpose. In no event shall EverLMS be liable for indirect, incidental, special or consequential damages arising from use of the platform. The terms include a privacy policy which describes data practices and your rights as a user. You agree to comply with all applicable laws, policies, and codes of conduct when using the platform. The terms may be updated from time to time and continued use after changes constitutes acceptance of the revised terms. This section also covers third party links, integrations, and content from external sources; EverLMS is not responsible for the content or safety of external sites. By using the program you consent to data processing and, where required, cross border data transfers in accordance with the privacy policy. Termination of access may occur for breach of these terms or for prolonged inactivity, and in such case you may need to re enroll or obtain authorization to re access. The governing law section states that these terms are governed by the laws of the jurisdiction chosen by the provider and any disputes will be resolved through binding arbitration or court proceedings as described in the policy. The terms emphasize that content remains the property of EverLMS and that customers acquire only a license to use the content for internal training purposes. Users are responsible for maintaining the confidentiality of their credentials and for activities that occur under their accounts. The platform may require periodic maintenance windows, during which access could be temporarily unavailable; EverLMS commits to communicating such periods in advance where feasible. Any notice of termination will provide a short grace period to allow a smooth transition and the opportunity to export data as needed for record keeping. By continuing to access or use the service, you accept and agree to be bound by these terms as well as any policies referenced herein.
